My understanding is that treaties are the equivalent of enacted legislation - the law of the land. However, all legislation is subject to The Constitution ... legislation that is determined to be unconstitutional is null and void. Therefore, I would submit that the enumerated rights in The Constitution take ultimate precedent over any treaty.

I will have to look into this, further.

Err ... Mr. Wizard - treaties DO trump the U.S. Constitution -- it is actually IN the Constitution that treaties take priority and precedence over U.S Law - both federal and state ... the Constitution is NOT excluded.

It is one of the 'proposed' Article V Amendments that I 'put up' a long time ago on this boards - it is a MAJOR short coming of the original Constitution- but was considered needed at the time by our founders in order to get support for our fledgling country at the time.

That is why the Pacific Treaty etc. are SO damn dangerous - it is the back door that the the STATISTS are continually attempting to use to completely usurp our Constitution.
