"No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

The Legal Information Institute summarizes the Fifth Amendment as follows ...

"The Fifth Amendment creates a number of rights relevant to both criminal and civil legal proceedings. In criminal cases, the Fifth Amendment guarantees the right to a grand jury, forbids 'double jeopardy,' and protects against self-incrimination. It also requires that 'due process of law' be part of any proceeding that denies a citizen 'life, liberty or property' and requires the government to compensate citizens when it takes private property for public use." ... {Any emphasis in bold is mine}.

With regard to the Jim Acosta situation, CNN clearly has no case in its lawsuit against The White House. The issuance of a White House press pass is not a legal proceeding - it is an administrative function. A press pass is not the property of Jim Acosta or CNN - it is a temporary, at-will, administrative authorization for a person to attend press conferences held at The White House. Therefore, neither Jim Acosta or CNN are being denied "life, liberty, or property" with the suspension of Acosta's press pass - to say that they are is simply ridiculous on its face. In fact, CNN has not been denied anything - there are several CNN employees who still retain their White House press passes. Jim Acosta's press pass was not suspended because he regularly spews FAKE NEWS and leftist propaganda - if it was, his pass would have been suspended long, long ago - no, it was suspended because Acosta irrationally chose to throw an infantile temper tantrum at a White House press conference that was completely outside the bounds of acceptable behavior. The White House is not suspending press passes willy-nilly against any presstitute who writes or broadcasts FAKE NEWS and/or leftist propaganda that is hostile towards President Trump - no, it is only Acosta who is being reprimanded for his overt display of childish behavior.

I realize a U.S. District Court judge has now arbitrarily and quite unconstitutionally inserted the words "and White House press pass" after the words "life, liberty, or property" into The Fifth Amendment and ruled that Acosta's White House press pass should be returned to him, BUT ... if this case goes before The U.S. Supreme Court ... poor lil' Jimmy Poo is going to be crying in the corner for a long time to come.
