HOW THE HELL IS THAT NOT MURDER IN THE FIRST DEGREE??? It was clearly premeditated. He returned to the scene of the initial confrontation, gun in tote, so it sure doesn't sound like an act of passion.

They haven't even spoken to him, yet they're calling it 2nd degree murder? This is so messed up.

I feel for you and your family, Nemo. Only those who have experienced the pain of a murdered family member would understand....

Federal authorities are looking for a Pine Ridge man charged in a Nov. 30 fatal shooting on the reservation.

Thomas Joseph Brewer, 26, will face a second-degree murder charge in the death of Shawn Stevens around 12:15 a.m. Brewer disappeared soon after the incident, authorities said.

Stevens and his wife were in their trailer at Pine Ridge’s East Ridge Housing when they saw an SUV spinning in circles in a nearby intersection, according to an FBI report filed in U.S. District Court. The couple were worried the SUV might hit their parked vehicle, so Stevens and another man went to speak with the SUV’s occupants.

The SUV was being driven by Brewer, who, during the conversation, displayed a dark-colored handgun, the report said.

Brewer then drove home, parked the SUV and walked back toward Stevens’ home with his three male passengers, authorities said.

“Stevens was in the middle of the roadway intersection talking to Brewer and the other three males,” the report said. “Brewer raised his right hand with a gun in it and fired a single shot, striking Stevens in his abdomen.”

Stevens was airlifted to Rapid City Regional Hospital, where he died on the operating table.

A 9 mm shell casing was found near the shooting scene, and a 9 mm “projectile” was recovered from Stevens’ body during surgery, the FBI said.

Stevens’ wife, who witnessed the incident and told police she went to school with Brewer, identified him as the shooter. If convicted of second-degree murder, Brewer could face up to life in prison.

Two of Brewer’s passengers were arrested in Pine Ridge on tribal charges, but Brewer and his other companion could not be found.
