“I refuse to take ‘no’ for an answer,” Mr. Obama said in Shaker Heights, drawing applause from his audience. “When Congress refuses to act and as a result hurts our economy and puts our people at risk, then I have an obligation as president to do what I can without them.”

...confirmations are a function of the Senate, not the house. The Democrats control the Senate. When Obamba says "congress fails to act" he is tryin to make folks think that the problem is in the house of representatives rather than the senate. In any case, neither the house nor the senate is his problem. The constitution is his problem.
