Well, the fact is that his tax losses were generated by non-cash deductions (i.e., depreciation, etc.). In other words, he was taking tax write-offs on his investment. Such deductions were (and still are, but over a longer time-frame, now) perfectly legitimate. All of my real estate clients were doing the very same thing in the late 80s and early 90s. You would have been a stone-cold fool not to take advantage of what the Internal Revenue Code allowed you to take.
