Oh, I would be SHOCKED if this former police officer were to be given the death penalty - THAT would be highly inappropriate in this case. You are quite correct ... his actions were absurdly reckless, but it absolutely was NOT premeditated murder.

...murder presupposes some sort of premeditation. Maybe voluntary manslaughter. Same thing but not premeditated. Penalties about as stiff except no death penalty for voluntary manslaughter.
