I suspect,
the problem here is 'local authorities' deciding
that 'no local crimes have been committed' (or pardoning
them) so they release the illegals rather than surrender
them to the federal authorities.
Cuomo can pardon state crimes, and if his ability to pardon is a plenary power under the Constitution of the State of New York, then there will be NO challenges. HOWEVER, Cuomo has absolutely NO authority to pardon federal crimes; therefore, if these people have federal warrants outstanding, there is NOTHING Cuomo can do to stop the federal government from prosecuting and/or deporting these individuals.
