This is about the two Lomp patents that the jury found valid and infringed. They were poured out by the ITC despite receiving claims construction from the CAFC. The CAFC told Judge Andrews to ignore the contradictory decision out of the ITC appeal. He pronounced and entered a judgment against Zte which they appealed and argued today. It will be interesting to see the result. Judge Andrews ruled on his claims construction based on the testimony of Lomp (the inventor). For some strange reason Mr. Merritt decided not to use Mr. Lomp at the ITC hearings.
