Duane Edward Buck is an African-American man on death row following his conviction for the shooting deaths of his ex-girlfriend Debra Gardner and her friend Kenneth Butler. He also wounded his own sister, who was also at Gardner's home.

...he was not charged with, arrested for nor tried with being black. I don't think it is against the law even in California.

BTW, this November, the people of California are being asked to vote on a ballot measure that would do away with the death penalty. We're also going to get to vote on the legalization of recreational marijuana (medical marijuana is already legal). And we're also getting a chance to vote on requiring the State of California to support a Constitutional amendment that would effectively vacate the 'Citizens United' decision.
