...there have been no cases on this issue brought before the supreme court is why ya have no decisions. The court does not just sit around all day making up answers to questions that have not been asked.

I agree, but there are no court decisions supporting this view or the opposite. It seems as if even the folks who carefully crafted The Constitution can't come up with all the possible scenarios.
