BTW, even Native Americans were not considered to be American citizens until the 1920's. It took an act of Congress to grant full citizenship to Native Americans born on reservation land. Up until then, reservation born women could only become citizens by marrying an already citizen and men could only become citizens by enlisting in the military. It was after the First World War when it became apparent that a significant number of American soldiers killed in combat were actually Native Americans who had joined the Army with the intention of gaining their citizenship, and this realization brought this issue to the forefront and so a few years later they passed the law giving Native Americans born in states or territories of the United States full citizenship. However, it was well into the 50's before the last state anti-Indian laws were repealed many of which was enacted specifically to keep them from voting or owning property.

However at the time of McCain's birth that was NOT settled law and thus the need for the retroactive law that was intended to cover all the children born to service families after the Spanish American War, the first time that American forces, mostly naval, remained deployed in permanent overseas bases. Until then, the few cases that came-up were handled as normal naturalization cases. It was when families were allowed to go overseas with the service members that suddenly this became a big deal.
