But we must keep in mind that at the time that John McCain was born in Panama he was technically NOT considered an American citizen. However, a few years later a retroactive law was passed which granted full citizenship to children born of American service families stationed overseas. Now this could have been an issue in and of itself since the Constitution (Article 1, Sections 9 and 10) explicitly forbids the passing of ex post facto laws, but the courts let this one slip through because it was not intended to deprive anyone of life or liberty.
BTW, this is one of the reasons that back in 2008 McCain never personally made any comments about Obama's birthplace or his citizenship and he ordered that all of his campaign staff to do likewise because he knew that when it came to the issue of 'citizenship', his situation was much more precarious than Obama's could ever have been (of course Sister Sarah and her bunch claimed to have never gotten that message).
