the circumstances should not have left the victim dead. any person can see that. but there's plenty of space for him to be negligent/dumb/panicky rather than evil.
and unless a person is clearly malicious, i tend to be cautious about assuming it.
today was the good day for the defendant. tomorrow he will find out how she treats his reaction. there will be consequences, as there should be, for shooting through a door at someone you haven't identified or allowed to surrender. if rs had been permitted a word in answer, pistorius would have known he must not shoot. he ought to be punished for this.
indeed, it might do him some good. he must find his own internal pathway to understand and pay for his error. appropriate punishment by society may help him find it.
