Apple is Apple. They do not base their decisions on the reasoning of others. Apple has been busy obtaining hold harmless agreements with its suppliers regarding infringement. This places us squarely in China. The arbitration with Huawei is the ticket for the next cruise. The ITC has been throwing spokes in our wheels for several years. Hopefully they will finally do the right thing. If the goal is to get the parties to settle, it would only seem logical to now find infringement to see if that works. The finding of no infringement did not work. The finding of erroneous claims construction did not work. Maybe, just maybe, the third time is the charm for MSFT/Nok. Every manufacturer knows they are using IDCC technology. Many license, but some play the word games in claims construction. Like it or not, IDCC and Qcom have been there since the beginning. Very few manufacturers today can make that claim.
