I believe the recent remand from the commission along with the markman hearing (judge basically says the same thing as the CAFC and commission with regard to power patents) seals the deal and made them come to the table.

the more these patents get proven "up" (quoting WM), the more expensive it will be down the line for these companies to sign, not to mention litigation costs.

I would expect more to the come knocking and asking for the terms from last year before the recent court rulings.

I recall seeing somewhere in another case (don't remember if it's vrng or vhc or somewhere else) but the judge said that the rate could be justifiably higher if litigation proves itself out for an infringer.
