normally, after an announcement like yesterday, we would tank pretty badly.
One of the following must be true:
1) everyone must realize that the Staff Attny is a tool
2) price already built in
3) nobody cares anymore
4) DI is non issue and will be reversed by ALJ/Commission, who has already ruled for DI in every IDCC instance before along with Cafc and supreme court denial
Let me clarify my understanding:
to avoid infringement, staff didn't side against DI for power patents from `613,but changed claims and ignoring cafc claim construction.
for the rest of the patents, staff went against DI(not sure if he thought that patents were infringed) so it didn't matter that the patents were valid and infringed.
I calmed down last night after I realized this guy has no power, but must like smartphones, and that his opinion doesn't count... see #1 above.
