I heard they will argue, can the congress change it to 90 votes? and if not, why is 60 alright?

I think 51 votes should at least get a bill to the floor for discussion.

In all honesty, it think this is a bit of a slippery slope. Granted, I think the recent changes with respect to appointments was correct since without the President being able to appoint whom he wishes to federal courts and cabinet/agency positions, this prevents him from doing HIS Constitutionally mandated duties. However, when it comes to day-to-day Senate business I suspect that the courts will rule against this lawsuit due to the fact that the Constitution spells-out that the House and Senate are allowed to enact their own rules for conducting congressional business. That being said, I think that if there's going to a filibuster, that it be the real thing, as in the style of 'Mr. Smith goes to Washington'. And that there should be no anonymous holds on appointments or legislation, it should be totally transparent and if holds are allowed that it must be accompanied with a public explanation and justification so that the people know who's doing what and why they're taking the action that they are.
