Merritt and Fagan also took credit for the Ericy settlement and created the press release that set out the amounts owed IDCC by Nok and Sam as a result. This blatantly violated the confidentiality clauses in both licenses. The BOD should determine what the actual difference was between Nok's 3g bid rate and IDCC's 3g ask rate. If it amounted to 25 cents or less, the money we have spent on legal fees would come out a wash. If we had been collecting from all of the players at x% per terminal, we would have loads of cash, would not have rushed to judgment in the Apple license and have a list like Qcom of paying licensees as we move to Lte. They should use the empirical data and if it is material, then ask for his resignation and get some new blood that is not tainted within the sector to salvage something for 3g and begin a uniform FRAND license applicable to any and all manufacturers period without deals for anyone including volume discounts. Creative licensing has been and will continue to be a loser if the goal is to license all of the manufacturers. We will no longer have to root on who sells the most terminals.

H48,

Quite honestly im not sure anyone new would make a difference at this point . There is waaaay to much history involved with IDCC/NOK/SAM/LG for someone to come in and all of sudden get deals done with the big boys. Remember WM has been with IDCC a long time and was there for the 2003 ERICY settlement, the NOK/SAM arbitrations and now the ITC cases. MGMT made the decision to go the ITC where so far we have rolled snake eyes twice, we have one more shot come February to get it right. Lets hope 3rd times a charm at the ITC. Don't get me wrong I am obvioulsy not happy with where we are(NAZ at 15 yr high, wireless growth everywehere, and were trading for $13 net of cash) but at this juncture they have the 868 as their final shot to get it right. We will know by May if we do.
