The stated goal of the ITC is to extract a settlement between the parties. Nobody likes the ultimate remedy handed to them. Even the complaining inventor would much prefer a license over an exclusion order. The ITC used to be a less costly method for the little guy to protect its IP. It is the big companies that have significantly increased the costs of seeking redress at both the ITC and arbitration. An exclusion order is a death sentence. Unless the ALJ is completely convinced that the respondent is clearly in the wrong, the initial determination will usually be a fence rider to be reviewed by the commission and the CAFC. Couple this with an administration that believes in selectively enforcing the laws on the books in this country and it makes it extremely difficult to formulate a business plan.

Will it ever occur to the ITC that there is something amiss with its "initial determination" phase decision making process in the IP arena?

InterDigital, Inc. (Nasdaq:IDCC), a wireless research and development company, commented on the notice issued today by the U.S. International Trade Commission (Commission) indicating that the Commission has determined to review in its entirety the Initial Determination in Investigation No. 337-TA-800 of wireless device manufacturers Nokia, Huawei and ZTE.

"We are very happy the Commission has decided to review the Initial Determination, and we are confident that it will rectify several clear errors and reach a decision that supports the value of InterDigital's innovations," said William J. Merritt, President and Chief Executive Officer of InterDigital. "We also welcome an examination by the Commission of the licensing record and FRAND obligations related to the investigation. A very thorough investigation on that issue is clearly important in terms of validating the injunctive relief that we're seeking. We are confident that the most thorough possible examination and documentation of this area will be favorable for InterDigital, given our strong licensing record and commitment to fair licensing."
