alea, I fail to see how a user being able to recover a key to their own device differs from the other things you mentioned in a structural sense.

The structure is the same. Somebody, the user, an agent of a court holding a subpoena, or the NSA waltzing about compelling gross turnover ... all of these are dependent on the exact same truth, the manufacturer can deliver access.

To me that has always plainly been the case (from a device structure perspective). Otherwise the Dell guy could't bail the user out years ago.

So knowledge about the device and its construction are unchanged, you are simply finding issue with how that might be used, but not a new understanding of the device.

Hi Dig,

The point is the process.

If a user can recover the key to their own device, no problem so long as their identity can be authenticated.

If a third party such as law enforcement can get a subpoena to access your device, that is permissible under probable cause and practical due to the key archive. That is targeted surveillance and I thing that is a balanced approach between the needs of security and privacy.

If a third party such as NSA can grab the key archive then it can continuously access your machine, store its content and communications and clearly associate the use of the machine with the user. SOD seems to have been set up to share data between interested government folks in acronym city such as DEA, FBI, CIA, IRS etc. That is something new and unpleasant. Non-terrorist, non-criminal individuals have legitimate secrets from the government.

TCG was originally sold on the concept there is no government back door. That looks increasingly nonsensical.
