hitkc,

neither murder nor manslaughter is provable without evidence to support it.

unfortunately for the prosecution, there was plenty of evidence. but it supported the defence. hence they appealed to the heart. which is nonsense in law.

major urban cities I recognize the importance of developing "street smarts." One quickly learns to avoid potential danger. An individual does sense potential danger and immediatley assesses options to avoid it. Is that profiling? Of course it is. Is that racist? It could be. Is it fright or flight, instinct or learned behavior. Is it learned behavior from experience or a consequence of media exsposure/maybe both? Don't Know. Either way I suspect either Z or T ignored their "street smarts" and allowed "macho" to prevail. IMO, FWIW, the prosecutors, whether purposely for politics or stupidly tried Z for a charge that simply wasn't provable. The evidence wasn't there. My guess is they knew that from the get go but feeling the pressure went for murder 2 when manslaughter might have had a chance.
