Then why the accusations that the court was taking an 'activist' role when they ruled on DOMA and the Prop 8 issue? How is what they did there any more 'activist' in nature than their ruling in the Voting Rights case? After all, 98 Senators and all but 23 Representatives voted to renew the last go around of the Voting Rights Act, a hell of a lot more than who voted for DOMA.
