Actually, according to the article, "It remained unclear how Matthew Warren had obtained a firearm."
Even if he bought it from an individual, if that individual was from out-of-state, it was not shipped to him directly. It went through a dealer.
If somehow the seller DID ship to him directly, or an illegal transfer was done (in CA, as I recall, face-to-face transactions must be done through a dealer), then I believe the seller should be charged with arms trafficking, and possibly some charges for the resulting death (murder? manslaughter?).
Punish the person who committed the illegal act, not everyone.
Edit: And looking at the update in the article, I see that the seller had already committed a Federal offense by having possession of a gun with the serial number scratched off. Unless Matthew did that, in which case he committed the Federal offense. It's just a matter of what crime(s) was committed at this point.
I stand by my previous statement - punish the ones committing the crimes, not the rest of us.
