In my opinion, the actions of Nok should be the case that all small inventors join to litigate the ban issues in as many levels that are available. You cannot get a better set of facts that expose the weaknesses of small inventors without the ban remedy. Nok is a textbook study on bullying and theft by trick. The world enforcement agencies should be educated on the actions of Nok taken against IDCC to the detriment of the company, its inventors and its investors. If the behavior of Nok does not merit the issuance of a ban, I doubt seriously that a ban will ever be warranted as a remedy for the protection of inventors in the USA and around the world.

If a ban is issued by the ITC, it should remain in force during any appeal procedures.

Assuming justice is served - and we win both infringement and validity, Nokia can appeal (I think that's a given). However, I can't remember if they would be subject to the 337 import ban during the time of their appeal.

Am I jumbling events, or are we at the stage where by October 2013, assuming justice is served, nokia will be subject to an import ban?
