As you know, I have been advocating that IDCC needs to paint the whole picture in its litigation efforts. If they had done so, this little opening for the wannabe infringers would not be available. A simple hour of testimony regarding the history of the company beginning with the phone call made in the streets of Philly in the mid 80's, B-CDMA, Nok joint developement, yearly demos in Barcelona, the IFX/Commeon stack, the slim chip, the investments in NY, Montreal, CA and ending in the total amount of legal fees expended in seeking licensing would clearly define the domestic industry issues. In fact, a summary determination would be in order. When I see the amounts of legal fees being paid each quarter and see that a lack of evidence argument is in issue, it makes me ill. 20 lawyers working on the case and not one is creative enough to prove up the standing to request a 337 investigation. C'mon man. High tech has its price and the lost art of persuasion is certainly a part thereof.

Now that we know what the appeal is about.... it kinda pisses me off that the following companies would jump in and file a brief in support of Nok. It does present a mild concern around lobbying.
I would say to them "none of your damn business"

or do you want to make it your business and take you to court too?
what does chrysler/ford have anything to do with this? Afraid of M2M licensing?

10/1/2012 MOTION: Entry 74 :by Other - Motion of Hewlett-Packard Co., Amazon.com, Inc., Chrysler Group LLC, Dell Inc., Ford Motor Company, and Red Hat, Inc. for Leave to File a Brief as Amici Curiae in Support of Petitioners
