if you really want to be creative...we should argue that protecting ourselves against thieving mofo's like nokia and their chinese cousins....should be considered a domestic industry all in itself....the lawyers would then have to call into question whether their work should or could be considered a domestic industry ,,,id love to see the tortured logic on both sides of the fence in that case.. I would be embarrassed to file an action of no domestic industry against a company that designed a slim chip being used in the wireless industry. If I was on the panel, I would issue 5 mil in sanctions against the Nok law firm. Word would spread and a lot of this time wasting, expensive bullshit would slowly go away. The problem is that the judge would have to issue sanctions on his/her own motion because the attorneys for IDCC certainly are taking advantage in the billing area. Second thought, issue a 5 mil sanction against the IDCC lawyers also for not filing for sanctions. IDCC should present the entire amount of legal fees paid trying to enforce its IPR against Nok. Is this how America protects its inventors?
