JOINT MOTION FOR LIMITED MODIFICATION OF THE
PROCEDURAL SCHEDULE
Complainants InterDigital Communications, LLC, InterDigital Technology
Corporation, and IPR Licensing, Inc. (collectively, “InterDigital”); Respondents Nokia
Corporation and Nokia Inc. (collectively, “Nokia”); Respondents Huawei Technologies Co.,
Ltd., FutureWei Technologies, Inc. d/b/a Huawei Technologies (USA), and Huawei Device
USA, Inc. (collectively “Huawei”); and Respondents ZTE Corporation and ZTE (USA) Inc.
respectfully jointly move for limited modification of the procedural schedule (Order No. 62).
On October 3, 2012, InterDigital wrote to ALJ Shaw regarding the scheduling of
depositions pursuant to Order Nos. 67 and 69. In particular, InterDigital raised concerns that the
depositions as scheduled could impact its ability to incorporate those depositions into its expert
reports due October 24, 2012. (See Order No. 62.)
On October 4, 2012, the ALJ issued Order No. 73, directing Respondents Huawei
and Nokia to submit responses to InterDigital’s letter, and specifically requested those responses
“contain the parties’ proposed solutions to the issues raised in InterDigital’s letter.” (Order No.
73 at 1.)

The parties have met and conferred and jointly propose a limited modification to
the procedural schedule to address the issues raised in InterDigital’s letter. Specifically, the
parties jointly request an extension of the deadlines for filing expert reports and rebuttal reports
by slightly less than one week each:

The proposed limited modification to the procedural schedule will not impact any other dates in
the procedural schedule, and will not require modification of the hearing date or target date.
The parties have met and conferred with the Commission Investigative Staff
regarding this motion. The Staff does not oppose this motion or the relief requested.
