NOKIA’S RESPONSE TO INTERDIGITAL’S MOTION FOR LEAVE TO
SUPPLEMENT CERTAIN EXPERT REPORTS BASED ON NEW
INFORMATION (MOT. NO. 800-142)
On August 10, 2012, InterDigital filed a Motion for Leave to Supplement Certain
Expert Reports Based on New Information (InterDigital’s “Motion”), seeking leave to
supplement the expert reports of Dr. Charles L. Jackson (regarding alleged infringement
of the 830 and 636 Patents) and Dr. Jonathan D. Putnam (regarding domestic industry) in
view of the Federal Circuit’s panel opinion in InterDigital Communications, LLC v.
International Trade Commission, No. 2010-1093 (Fed. Cir. Aug. 1, 2012). Nokia does
not take a position with respect to InterDigital’s Motion, but merely notes that, in the
event that the ALJ grants InterDigital’s Motion, Nokia reserves its right to supplement
the applicable rebuttal expert reports in order to provide corresponding rebuttal opinion.
