brilliant move to counter Nokia's discovery request and regarding products made by IDCC relating to Domestic Industry. In the filing IDCC included the recent case decision by the CAFC on 8/1/12 regarding IDCC meeting the Domestic Industry without producing any physical products. The brillian part is they filed the entire decision which also addressed the patent interpretation reversals and remand to the ITC by the CAFC panel. Now those patent determinations are out there for all the infringers to see and also for the ALJ to look at when constructing the claims in the patents insuit before him in the current case.
As the 800-613 CAFC decison was precedential it sets or reinforces guidance on how patents are to be construed. The following document is on the ITC webbsite and is public.
