This is all just posturing to determine whether repeal efforts can go through reconciliation or are subject to cloture.

The point important in this (I'll take comments from 24601 at any time on this) is that we are referring to the internally adopted rules of the Senate, the Senate makes its own rules, the rules it runs by are its choice, so the notion that some external force plays pivotal on whether that body chooses under its rules to follow traditions of cloture or traditions of reconciliation are at best peanut gallery sillyisms.

The Senate will decide which traditions it will handle repeal efforts under ... Rep Pelosi, Justice Roberts, and I all have little say on the matter.

Hi clo,

In my mind, we can call it what we will, but it has some features of a tax and some of an extension of insurance, so trying to define it using words designed for greater specificity is pointless.

Assuming a Romney presidency and Republican majorities, definitions will matter less than expediency.
