hi tkc,

i don't think the republicans will worry about definitions too much.

if they have all three layers of the process in their hands, it seems they will treat it as a tax.

maybe john roberts set up a kind of judicial referendum.

Reconciliation is supposedly used only to produce a budget - reduce expenses or increase revenues. My understanding is that if a bill (as scored by the COB) doesn't add costs it can't be considered in reconciliation. Obamacare has been scored as reducing costs. Reconciliation disallows the filibuster thus only requires 51 votes to pass. I suppose if the GOP wins a majority (or gets enough "Bluedogs") and Romney wins then maybe they could figure out how to do it for a 2013 budget reconciliation. I see it as a big stretch but even then it wouldn't happen 'til late summer/fall 2013 at best. Too many hurdles to my thinking..
