They are approaching the discovery deadline. LG has been terminated from the investigation by the ALJ awaiting the review of the ITC. IDCC wants to be able to either depose the LG personnel that have been declared as witnesses for the evidentiary hearing in case the ITC overturns the termination or in the alternative have a ruling that the witnesses be precluded from testifying at the evidentiary hearing. It is a reasonable request and it should be granted. The IDCC lawyer is trying to avoid trial by ambush.
