Nokia, is that Nokia has to stand their ground and show the world why they don't infringe. And they can start with the patents that IDCC motioned the ITC for summary judgement of infringement against Nokia. Additionally, Nokia can take that FRAND defense and shove it where the sun does not shine. And the same goes for ZTE and Huawei, and LG if they are not allowed to arbitrate by the ITC Commission.
But on the other hand Nokia can always come to a FRANDLY commerically acceptable license that IDCC is willing to accept. In fact, I say that Nokia can start with their own FRAND declaration rate for Essential patents, which I recall is about 2.5%. With such an offer I think IDCC will entertain that as a good starting point.
MSFT you better tell Nokia to fold their tent because if they lose at the ITC your phones will not be allowed in the country. And that will go for the one's being made by ZTE as well, when they lose the case that they don't have a leg to stand on. Oh, I forgot they are hangin onto Nokia's coat tail. In the meantime MSFT buy more phones from HTC they at least have an IDCC license.
