I understand that, I was trying to explain why it is hard for the Judge to throw out the case based on an "agreement" at ETSI when the parties how not really agreed on ANYTHING? How can you have an agreement for essential patents and use that agreement to side step the ITC when you are fighting on the other fronts...

all these are just common defenses every itc case uses.

invalidity
etc...


they throw them all hoping to stick on the wall but also to make sure they don't forfeit any in the future.
