Annoying though his behavior was, was it CRIMINAL? We see kids walking behind newscasters and doing stupid things on live TV all the time. I'm pretty sure that THEY don't get arrested for it...
If, as capt_nemo said, the guy was drunk/stoned, I'm sure they'll slap a 'drunk and disorderly' charge on him. He probably spent the night in the drunk tank, and went home.
If "Attempted stupidity" were criminal, the jails would be a LOT more crowded.

What is the point of rules that are not enforced?
