IDCC had better stand up and present its Nok story to the FTC or they will soon find themselves without a many of its causes of action with the ITC. IDCC needs to point out emphatically that the obligation to license and pay royalty is a two way street for members of the standards bodies. Now we have HP, another computer company desiring to join the wireless sector, fronting for Nok. I doubt that HP is even a member of the standards groups.

IDCC needs to file a Declaratory Judgment action to establish a method of determining a FRAND royalty rate and serve every big player in the industry. Make them testify how they reach their rates.

POINT OUT the scorched earth policy of Nok and how they weazel when a loss is eminent.

Try Germany as a venue.

It is time to FIGHT. If you continue to negotiate with bad faith players, you are going to lose. The world is being run by socialists and that is real bad for the business model unless you secure a judicial victory regarding royalty rates. The big boys do not want their royalty rates cut and you must play this to your advantage.
