Non-party Nokia Siemens Networks Oy (“NSN”) filed a Motion to Quash InterDigital’s
Letter of Request and Motion to Request the Central Authority of Finland [to] Stay Its Decision
During the Pendency of the Motion to Quash. Motion Docket No. 800-55. Complainants
InterDigital Communications, LLC, InterDigital Technology Corporation, and IPR Licensing,
Inc. (collectively, “InterDigital”) filed an opposition to NSN’s motion, and the Commission
investigative staff (“Stafi”) also filed a response opposing the motion.
lnterDigital and the Staff oppose the motion on several grounds, including the fact that
NSN failed to follow Ground Rule 5.e. because it failed to certify that it contacted other parties
to resolve the matter prior to filing the pending motion. Opp’n at 5-7; Staff Resp. at 3. In view
of the public and private resources already consumed by InterDigital’s efforts to obtain Nokia
information, it was particularly incumbent upon NSN to work with InterDigital to resolve any
disputes before filing the pending motion. Other parties, including the Nokia companies that are
already respondents in thisinvestigation (i.e., Nokia Corporation and Nokia Inc.), could be
instrumental in helping InterDigital and NSN resolve the matter. '
Accordingly, Motion No. 800-55 is denied.
