I'm NOT surprised that the person with the gun usually believed to be the aggressor.
But it still stands that the simple act of following someone isn't necessarily a crime. Even if the follower has a gun in his/her pocket. But I can certainly see if the followee gets injured, the first person everyone examines is the follower (if the follower is armed).
