I don't agree.
The word is "or". And as a legal matter, they are simply leaving open every possible option given the uncertainty (theoretical or practical) of future availability.
Grammatically, the $2m sentence describes the net proceeds of the ATM included in the cash currently on hand. That amount, described above in the report, is $2.3m.
It amazes me that anyone seriously thinks it implies anything else.
