COMPLAINANT INTERDIGITAL’S MOTION SEEKING RECOMMENDATION
TO THE DISTRICT COURT FOR THE DISTRICT OF COLUMBIA
TO ISSUE A LETTER OF REQUEST
Complainants InterDigital Communications, LLC, InterDigital Technology
Corporation, and IPR Licensing, Inc. (collectively “InterDigital”), pursuant to 19 C.F.R.
§ 210.32 and § 210.26, hereby move for the Administrative Law Judge’s Recommendation that
the District Court for the District of Columbia issue a Letter of Request on behalf of InterDigital
to obtain documents and deposition testimony from the following foreign third party:
Icera, Inc.

InterDigital seeks foreign discovery from Icera, Inc. (“Icera”) because Icera is a
manufacturer of baseband processor chips used in wireless devices, including 3G-enabled
cellular telephones and peripheral devices. On information and belief, one or more Icera
products are used in Huawei Technologies Co., Ltd., FutureWei Technologies, Inc. d/b/a Huawei
Technologies (USA), Nokia Corporation, Nokia Inc., ZTE Corporation, ZTE (USA) Inc., or LG
Electronics, Inc., LG Electronics U.S.A., Inc., and LG Electronics Mobilecomm U.S.A., Inc.’s

(collectively “Respondents”) wireless devices, including certain of Respondents’ wireless
devices that infringe one or more of InterDigital’s U.S. Patent Nos. 7,349,540; 7,502,406;
7,536,013; 7,616,970; 7,706,332; 7,706,830; 7,970,127; and 8,009,636 (collectively, the
“Asserted Patents”) in this Investigation. Icera is believed to be most knowledgeable about the
operation of its processors, products, associated software or firmware, and other components
used in these devices. The operation of these processors, products, associated software or
firmware, and other components is relevant to the issue of whether Respondents’ devices
infringe the Asserted Patents.
