Funny how strict constructionists think the question "what did the founders intend?" over-rules the notion of "what do circumstances demand?". In Darwinian terms, this is the original sin of the US Constitution.

If generational change within a population is not permitted, then the changes to the environment which it inhabits will destroy the population.

Even butterflies know to head North when the climate warms.

I think this is essentially the democracy invented by the supreme court.

The irony, of course, is that democracy cannot trickle down, any more than the imaginary economic trickle down effect actually involves money trickling down. Hence the increasing concentration of wealth when taxes are low.

Same with democracy. The rich represent their own interests. Democracy is intended as a mechanism to give voice to the interests of the people. It is meant to restrict the power of the few.

So much for that.
