while I do not pretend to know what may be happening in the SA process....i do not believe the CAFC decision is delaying the SA. A positive decision for IDCC at the CAFC would be an incremental step forward and a negative for IDCC at the CAFC will be a step backward, but is already backup by additional filings by IDCC at the ITC, against the hoard.
Either way the CAFC decision in the medium to long term is just one step in a very long drawn out legal process of IDCC to defend and recognize the value from its IP. All potential buyers understand this because they are in the throws of the legal battles also...and a total loss at the CAFC doesn't change IDCCs need to continue a long term strategy of defending its IP.
Previously, I thought the CAFC was a hold up, but it just doesn't make any sense. No matter win or lose, the war defending IP continues...the CAFC decision doesn't conclude anything and close the door. It is just one more move on the chess board. Buying companies always suspect that there are outstanding legal issue with any company they are going to purchase, they just need to know worst and best case scenarios...and the CAFC decision at worst case is a set back.
