zz, I am just an accountant, so please go easy on me...why didn't we use this tact earlier? Is it really a new idea to present the infringed property in the act of infringement? Was there something holding IDCC back from using facts?

Okay, I know I am being a wisenheimer. But seriously, is there an obvious reason I missed that would prevent IDCC from using ALL the facts to support their position????

It is heads and shoulders above the last effort. We will be using the actual operations being used in the terminals and infrastructure to determine whether IDCC technology is present which will seriously deter an expert for an infringer from stating that the subject terminals do not use the patent claims involved in the 337 investigation. This will make it much easier for the ITC attorney to side with IDCC as the case matures and heads for the evidentiary hearing. This will incent the infringers to settle rather than fight both IDCC and the ITC lawyers.
