This patent might have been delayed to make sure the power ramp and short code langauge rendered the Nokia arguments moot. It looks to me like the ramp up language was made more broad and the short code was defined. I guess this is why it was brought into the fight. Not sure what Flynn will argue with this one? They did not specify the weather during which the power is increasing??
