Up *IS* a safe direction. But it must be sufficiently "up" that the actual forward velocity of the bullet when it comes "down" is negligible.
This was proven on MythBusters, by the way. Falling bullets are no more deadly than falling pennies.
The fact that this bullet killed someone a mile and a half away tells me that the gun was aimed "up" about as much as it would be if I knelt and took a bead on someone's head across the room.
Negligent homicide, open and shut.
