I talked to his admin who was very sweet and she forwarded me to his cell phone. I was suprised and happy he took my call. I spoke to him for about 20 minutes but as we all know he has no more inside information as to the outcome or the timing than we do. I thanked him for handling the case and mentioned that many shareholders I talk to feel like he really did a good job. He mentioned that they did 4 mock arguments in preparation and that is the most he has ever done. (that says a lot) He said that he felt they were very prepared and confident going into the argument and felt even better after the argument. He mentioned that he had 7 arguments this year at the CAFC and was still waiting on 5 of them. As has been mentioned by Nuke and others Mr Dunner feels that Judge Newman could be writing this up which might be the cause of the delay. Dunner expected a long wait based on his hunch that Newman was the writer but we are now taking even longer than anticipated. He said the longest he has waited was 2 years and it was affirmed!! As for the timing he thought it was imminent 3 months ago so it could come literally tomorrow. He did mention that every time a decision is released they analyze the cases in the queue and the judges that wrote them to try and determine which might come next. Nothing said by Dunner was new information or more than what has been said before but it was nice to hear it directly from Mr Dunner. Dunner seems to be very down to earth but confident in what he does for a living. Anyway, we along with Interdigital and Mr Dunner are still in waiting mode and there is no such thing as a slamdunk but we are in good hands imo. I know DnDodd thinks I am wrong but I still feel that we are in a holding patern waiting for this decsion. I cant see how you could make an offer for a company with such a HUGE decision seemingly days away as it has been since the SA decision was announced in July. It does not matter that it is only 2 patents of 18,000 and there are new patents issued and there is a new case, etc. This is about having Nokia and Microsoft by the balls with a HUGE tab. Also, for those interested Dunner mentioned that his arguments for Akamai against Limelight a few weeks back were very interesting for those that like to follow some of these cases. There were back to back arguments that each took an hour.
