I've been stymied, btw, in my attempt to buy land in New Hampshire. My lawyer has done NOTHING in the last two months and now, per the contract, has only until December 1st. The problem is, the Board of Selectmen for the town meet only twice a month.. the 2nd and 4th Mondays. So, the only real opportunity my attorney has to make his case is on November 14th. He hasn't yet even petitioned to be on their schedule for that meeting!
It's pretty frustrating. He's a top notch real estate lawyer, and he certainly SEEMED confident my variance would sail through. The last thing I expected was that he'd drop the ball, but that's what he's done. (He assures me that he's now going to make up for it.)
The problem is, if the board delays him until the 28th, there's probably not enough time to get everything done. And even if they don't delay him, the whole thing is still up in the air. He told me yesterday that there's a slim chance that the Board of Selectmen can't issue the variance themselves. It might have to be taken up with a Zoning Board.
Unbelievable. The seller is getting impatient... and is probably as frustrated as I am. The contract says that an extension can be obtained so long as "good faith effort" is being made to obtain the variance. But, with my lawyer having gone this long without even contacting the Selectmen, I wouldn't blame the seller if he says that a good faith effort has NOT been made.
