it was brought to my attention that you are talking to me.
if you want to respond to me, do it here, not over at IHUB.

In my opinion, there are only 2 candidates that the underreporting occurred, either HTC or RIM. otherwise the licensee would have to be listed as 10% per the press release.

You can feel free to call IR if you like and ask that same question.

btw, since you don't know what price the royalty affects, you can't say for certain it is based on ASP.

Bill Merritt himself basically says that they collect up to some amount but not the full price of the phone.

I think i can (safely) conclude that it is HTC that has been underreporting/underpaying and the audit revealed that.

it was not until recently that HTC became a 10% reported customer, even thought they have been rocking along for a while now.

after speaking with Janet Point a while ago and questioning the audit and the 10% statement in the earnings release, although she didn't explicitly say who the audited licensee was, she stood behind the 10% statement in the earnings release.

if my assumption is true, the rate for HTC is probably higher than those over at ihub has been calculating (they know who they are and i know they read this board).
