But his SENTENCE was based on the testimony of a so-called 'expert' who claimed that Blacks were more violent and were more likely to commit similar crimes in the future, and this was one of the primary criteria needed to be met, that the person would likely commit a similar crime in the future, before someone can be sentenced to death in the State of Texas. Which means that if the circumstances had been exactly the same, except that the defendant had been WHITE, then the 'expert' would NOT have testified in that manner and it's possible that the WHITE defendant would have gotten life in prison instead.
That's a case of racial discrimination, pure and simple.
