It's been reported than as many as 1 in 10 people executed in America should not have been. Now this does not necessarily mean that they were all innocent (although it's suspected that many were), but rather that their conviction and subsequent sentencing did NOT meet the minimum legal criteria as laid out in the particular state's own judicial rules as to what determines whether a capital crime has actually been committed or that the death sentence was arrived at in a legal and/or just manner (which the Duane Edward Buck case in Texas and the Troy Davis case in Georgia clearly raises issues over).
